Judges in the Supreme Court and High Courts in India are appointed by a Collegium. In this Collegium, the Chief Justice of the Supreme Court, besides the other four Supreme Judges of the Supreme Court is included. Coalgium arrangements have always been questioned because its process was confidential. Recent changes have been introduced in this system.
Recently brought changes in the process of appointment and transfer of judges:
- Procedure related to appointment and transfer of judges will be made transparent and the previous arrangement of confidentiality will be abolished.
- All the recommendations made by the 'Collegium' will now are made public on the website of the Supreme Court.
- Only the recommendations related to the appointment and transfer of judges will not be made public, but the basis of these recommendations, the details will also be made public.
- Recently, the Collegium issued a new era of transparency and issued recommendations on the appointment of 13 judges of Kerala High Court and Karnataka High Court in their website.
- On October 3, 2017, a resolution was passed by the Collegium, which was approved. According to this proposal, whenever any person will be recommended by the government for appointment, transfer, permanent or appointment in the Supreme Court, all information will be made public on the website.
How will this step help in improving the image of the judiciary?
- This step will increase the faith of the people in the judiciary as the question of the judiciary was being raised due to the opaque system of the collegium.
- Due to the opaque system of the collegium, there was a long struggle between the executive and the judiciary. Adopting this transparent system will also help in enhancing the harmony between executive and the judiciary.
- Above all, adopting this transparent system will improve the judiciary's image in the country as well as at the global level, because India is the only country where the judge appoints judges.
