Recently, the Supreme Court has given recognition to the right to marry mutual consent by two adults while giving an important decision. The Supreme Court has clarified that if two adults marry with mutual consent then no third can stop them.
It is worth noting that this authority has already been provided by the Constitution, but in practice it has many problems in implementing it. Article 21 clearly states that if a person wants to be married to a different caste or community person then his or her parents cannot stop it legally. It has to be bothered or misbehavior.
The decision was made by the Chancellor, headed by Chief Justice. He also clarified that a high level committee of senior police officers will also be constituted to provide protection to adult couples and to get them married for their well-being.
How will the Supreme Court's decision help in controlling Honor Killing and Khap Panchayats?
The incidents of honor killings are continuing in the country. This process started with the Manoj-Babli massacre and is still continuing. Recently, a youth named Ankit Saxena was killed in Delhi.
On the action taken against Honor Killing and Lovers Couple, the Supreme Court made a clear comment and told Khap Panchayats that they were not the contractors of the society. Whatever action will be taken in this regard, it will be according to the law.
When counsel submitted by Khap Panchayats argued that they only oppose the split marriages. Section 5 (5) of Hindu Marriage Act also prohibits marriages. The lawyer said that they are not against interdependent and inter caste marriages. The Supreme Court, while rejecting the above arguments, said that whatever action will be done under the law. The khapas have no rights.
The Supreme Court has also sought suggestions from the government and other parties regarding providing proper security to adult couples.
Above all, the court also gave an example of their previous judgment during this judgment. The court, giving the example of Nitish Katara, said that if two adults get married with consent then the matter ends here.
