In India Child marriages are prohibited by law POCSO and child marriages act of 2006 but is is still following as a custom in many states such as Rajstan, Harayana, Bihar etc.The recent judgment of supreme court is the welcome steps for girl child, married women who is facing sexual harassment problem by after marriage.
Positive Consequences:
1. Girls child can file petition those who are facing such type of problem.
2. There are many wife who are facing such problem after marriage they are free to choose with their consent.
3. Will curb trafficking of girl chinld in the name of marriage.
4. Will helpful for declaring the child marriage null void.
5.Establishes a nexus between all the laws that are enacted to protect the girl child.
Negative Consequences:
1. There are many marriages are without consent of girl since girl are not ready to sex with husband since this will bring husband and his family in trouble.
2. Since there are burden of cases in high court and other court since it will make more burden on court and increase in the pending case.
3. the whole judgdemen is not covered under purview of IPC 375 since it has to cover.
CONCLUSION:A supreme court said A girl child below age of 18 can nit be treated as a commodity having no say her body or someone who has no right to deny sexual intercourse to her husband.
