The Constitutional Amedment 73 :-
- The following are the significance of this Amedment -
- The Panchayats were provided the Constitutional Reconigitation.
- Panchayati Raj provided the approval three levels :-
(i) Village Level - Gram Sabha
(ii) Block Level - Panchayat Committee
(iii) District Level - District Council
- The states with population less than 20 lakh were allowed to estamblish the middle level - Panchayat Committee.
- Reconigition to the 'Gram Sabha' (article 243a)- Under this article, all adult registered voters to the village are included & the State Legislature has the authority to make the law regarding this.
- The term of the Panchayati Raj Institutions for the 5 years.
- The minimum age for partipicpation as a candidate in the election of Panchayati Raj Institution is 21 years.
- SC/ST are provided tire reservation in the ratio pf their population.
- 1/3 seats are reserved for the women in Panchayati Raj Institution; which is now 50% through the Amedment 9.
- The provision for 'State Election Commission' is given for regular election of the Panchayati Raj Institution.
- The 'State Finance Commission' is provided dor the Financial Review of the Panchayati Raj Institution.
- The states were authorised to provide the representation of MLA & MP in the Middle Levels panchayati Raj and the Upper Levels (District Council).
The Functioning of the Constituent Assembly :-
- On 14th of November , 2011 the Public Service Guarantee Act (2011) was implemented in Rajasthan bythe State Government to provide the goods and services to the public on time.
- 15 departments of the State Government & their 124 services are included in it at the time implementation of this law.
- The Public Service Guarantee Act was expanded on 1st July 2012 by including the 18 departments and 153 services.
The following Provision is given to the act
-- The officers or the staff will provide the goods & the services to the consumer on time
-- If the officers / staff delay in providing the goods & services , he/ she will fined minimum Rs. 500 to maximum Rs. 5000.
Challenges to the Panchayati Raj :-
- Lack of adequate financial resources.
- Illiteracy
- Ambiguous distribution of subjects.
- Dependency of women representstive on men
- Party politices
NOTE :- The State Election Commissioner is appointed by the Governer but can be dismissed by the President through impeachment in the Parliament; like the High Court Judge.
Eligiblity :-
- Name should be listed in the voters list of Panchayati Raj bodies.
- should not be woking at any advantages or salaried post in the local authority & the Panchayati Raj body.
- Should not be suffering from physical and mentally disorder.
Election Process :-
- The Sarpanch & Ward members Representative are elected by the adult voters of the Gram Panchayats & the deputy Sarpanch is elected on the basis of majority of the representative of the Wards.
- The Sarpanch has the authority to give the decisive opinion.
TERM :-
- The time period of this process or Sarpanch is 5 years.
Resignation :-
- The Ward Respresentative, the Deputy Sarpanch & the Sarpanch sends the resignation to the Development Officers.
