In accordance with the provision of the of the act the government has set up a Commission known as MRTP Commission. the act provide that the commission shall consists of a chairman not less than two or not more than 8 other member to be appointed by central government.
jurisdiction and power of the commission
the MRTP commission is vested with the power to enquire into restrictive, monopolistic and unfair trade practices.
the commission inquire into any restrictive trade practice are there on the application of director general of Investigation or upon a reference made by central or State government. or all receiving complaints from any trade or consumer Association having a membership of not less than 25 person or upon own knowledge.
for the purpose of any inquiry under this act , the commission has the same power as a vested in a civil court under Civil Procedure Code, 1908, in respect of-
- summoning a witness and his examination oath.
- Discovery and production of evidence
- reception of evidence on affidavit
- Requestioning public record from a court or an office
- issuing a Commission for the examination of a witness.
the proceeding before the Commissioner judicial proceeding and the commission is Deemed to be a Civil Court.
